三、船運(yùn)問題
9、 免箱期：
1） 不得少與14天； 2） 如果賣方租船，免箱期少于14天，一旦造成有關(guān)船務(wù)公司滯箱、港口公司的滯港、海關(guān)的滯報等費(fèi)用，應(yīng)該由買方承擔(dān)。 3） 因?yàn)橘u方因素造成的免箱期不足，賣方應(yīng)該協(xié)助買方順延免箱期。 10、 船期和行船周期
1） 歐美亂碼紙/廢塑料運(yùn)往中國主港的航運(yùn)時間不得超過45天； 2） 歐美廢紙運(yùn)往中國主港的航運(yùn)時間不得超過35天。 否則，賣方應(yīng)該承擔(dān)買方因?yàn)槭袌龅鴥r造成的損失的50%。該跌價幅度計算，按照國際平均行情計算。
四、索賠
11、 買方提出索賠的時間
買方在貨物到達(dá)后45日必須提出索賠；超過45日，賣方可以不接受買方的索賠
12、 賣方支付買方提出索賠的時間
在雙方議定索賠之日起，賣方應(yīng)該在15日內(nèi)全部支付買方索賠金。時間計算，以買方銀行收到賣方的銀行電報單據(jù)為準(zhǔn)；
索賠金不能按時支付，每超過一天，賣方應(yīng)該追加索賠金總額的1%。
超過60日，賣方依然不支付買方索賠金，買方應(yīng)該提出仲裁或向法院起訴。
13、 貨到目的港后45日內(nèi)，賣方不處理質(zhì)量等問題引起的糾紛，買方應(yīng)該提出仲裁或向法院起訴。 14、 仲裁或法院判決采用的法律，應(yīng)該是買方國的法律；如果買方國的法律無據(jù)可依，應(yīng)該采用當(dāng)時的通用國際慣例處理。
